Private; K Company in 5th regiment of VT Vols; missing in action [first thought discharged] and then determined to have died in action during battle. His captain wrote a statement saying Kennedy was in his company and that the killed men in the Battle of Savage's Station near Richmond VA were taken by the enemy and he could not say how Kennedy died.[states he "no doubts he died of wounds."]

On 25 June 1862 began the Seven Days Battles as Gen Robert E. Lee engaged Gen George B. McClellan's Army of the Potomac prompting McClellan to withdraw to the James River. Just north of here on 29 June, Brig General John B. Magruder's division attacked Brig General Edwin V. Sumner's corps which formed the Union rear guard near Savage's Station on the Richmond and York River RR. Sumner gained the safety of the depot and held his ground until the fighting ended in a draw about 9 pm. the Federals retreated south to Malvern Hill in the night abandoning some 2500 wounded at the depot.

The final actions of the evening were by the Vermont Brigade, commanded by Colonel William T. H. Brooks, of Brig. Gen. William F. "Baldy" Smith's division. Attempting to hold the flank south of the Williamsburg Road, the Vermonters charged into the woods and were met with murderous fire, suffering more casualties of any brigade on the field that day. The brigade as a whole took 439 casualties; the 5th Vermont regiment, commanded by Lt. Col. Lewis A. Grant, lost nearly half of its men, 209 of 428.
